Help! I’m Being Sued!

What Should I Do if I am Being Sued?

Sample Summons (Not appropriate for use)

If you received a notice of a lawsuit against you, often called a summons or order to appear in court, stay calm. It might not a big deal. It may be a frivolous lawsuit, designed to intimidate you.

The best way to know whether the lawsuit has any merit is to consult with a lawyer ASAP. Even if you think you did nothing “wrong.” Perhaps you didn’t, but you still may (or may not) have done something technically illegal. And if that’s the case, then you may end up paying out some money to someone.

Whatever you do, don’t ignore the summons. If a person being sued doesn’t respond and doesn’t show up to court, the court can issue a default judgment against them.

Keep in mind that the person suing you would almost certainly prefer not to go through the whole trial and all, so try to negotiate and work out a settlement. But your lawyer will help with all of this. See How to Determine Which Kind of Lawyer I Need?
